Terms of Service

1. Who we are

CloserKendo ("CloserKendo", "we", "us") is operated by Ali Raheel, a sole proprietor trading as CloserKendo, Lahore, Pakistan. These Terms govern your use of closerkendo.com and the CloserKendo service. By creating an account or using the service, you agree to them. If you don't agree, please don't use CloserKendo.

2. The service

CloserKendo is software for practising sales calls. You set up a practice call, hold a live voice conversation with an AI-simulated prospect, and receive an AI-generated scorecard and transcript. CloserKendo is a software product. It doesn't include human coaching, consulting or other services performed by people.

3. Your account

  • You must be at least 18 years old, or the age of majority where you live, to use CloserKendo.
  • You must give a valid email address and verify it. Each account is for one person.
  • Keep your password secure. You're responsible for activity on your account.

4. Plans, billing and renewal

CloserKendo offers a Free plan and paid subscriptions, described on our pricing page. Paid subscriptions are billed in advance each month and renew automatically until you cancel. Prices are shown in US dollars; applicable sales tax or VAT is calculated and added at checkout.

Our order process is conducted by our online reseller Polar Software, Inc. (Polar). Polar is the Merchant of Record for all our orders and handles payment, tax and invoicing. Your purchase is also subject to Polar's buyer terms, presented at checkout.

Each plan includes a monthly allowance of practice minutes, measured by the second. The allowance resets on the 1st of each calendar month, and unused minutes don't carry over. When your allowance runs out, a call in progress wraps up and new calls can't be started until it resets or you upgrade.

If we change the price of a paid plan, we'll tell you by email at least 30 days before the change takes effect, and it will apply from your next renewal after that.

5. Cancellation

You can cancel a paid subscription at any time, from the Billing page in your account, by emailing support@closerkendo.com, or through the subscription management link in your receipt. Cancellation stops future charges; you keep your paid plan until the end of the period you've paid for, after which your account moves to the Free plan. Cancelling doesn't delete your data; see our Privacy Policy.

7. Acceptable use

You agree not to:

  • use CloserKendo for anything unlawful, or to create harassing, hateful or sexually explicit content;
  • enter other people's personal information (for example, in a prospect description) unless you have the right to;
  • probe, disrupt or overload the service, bypass usage limits, or access it by automated means other than those we provide;
  • copy, resell or sublicense the service, or reverse engineer it except where the law allows.

8. Your content

You own what you create in CloserKendo: the challenges, prospects and objections you write, and your call recordings, transcripts and scorecards. You give us permission to store and process that content only as needed to run the service for you, including sending it to the service providers listed in our Privacy Policy. We don't sell your content and we don't use it to train AI models.

9. AI-generated output

Prospects in CloserKendo are fictional AI simulations, and scorecards are generated automatically. Output can be inaccurate or incomplete. It's practice and feedback, not professional advice, and we don't guarantee any particular sales result.

10. Our intellectual property

The CloserKendo software, design, name and built-in content belong to us. These Terms give you a personal, non-transferable right to use the service while your account is in good standing.

11. Changes and availability

We work to keep CloserKendo available and improving, but we may change, add or remove features, and the service may occasionally be unavailable for maintenance or reasons outside our control.

12. Suspension and termination

You can stop using CloserKendo at any time. We may suspend or close an account that breaks these Terms, telling you why where we reasonably can. If we close your account without cause, we'll refund the unused part of any subscription you've paid for.

13. Disclaimers and limitation of liability

CloserKendo is provided "as is" and "as available". To the fullest extent the law allows, we aren't liable for indirect, incidental or consequential losses, such as lost profits or lost sales, and our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms limits any liability, or any consumer right, that can't be limited by law.

14. Changes to these Terms

We may update these Terms. If a change is material, we'll tell you by email or in the app before it takes effect. Continuing to use CloserKendo after that means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of Pakistan. This doesn't take away any mandatory consumer protection that applies where you live.
